These Terms and Conditions (“Terms”) govern access to and use of the Aparna.luxe website, social channels, and services operated by Aparna (“Aparna.luxe”, “Aparna”, “we”, “us”, “our”). By accessing, browsing, or purchasing from our site or channels, the user (“you”, “customer”) agrees to be bound by these Terms, our Privacy Policy, Shipping & Delivery Policy, Returns & Exchanges Policy, and any additional policies referenced or made available by us from time to time. If you do not agree, please do not use our services.

1) Eligibility and Account

2) Products and Services

  • Aparna.luxe is a premium saree brand. Product descriptions, images, dimensions, weaves, and colors are provided for information. Due to photography, lighting, screen settings, and handcrafted processes, slight variations in color, pattern, or finish may occur and are not considered defects.

  • Limited quantities may be available, and products are subject to availability. We reserve the right to limit sales per person, household, or order.

  • Customization, pre-orders, and made-to-measure items may carry special terms, extended timelines, and may be non-returnable unless defective per our Returns Policy.

3) Pricing, Taxes, and Payments

  • Prices are in INR unless stated otherwise and are subject to change without prior notice.

  • Applicable taxes, shipping, duties (if any), and fees will be shown at checkout. GST will be levied as per law and our GSTIN is 19EGZPB8884C1ZM.

  • We accept payments via approved payment methods displayed at checkout. By submitting payment information, you represent that you are authorized to use the chosen method.

  • In case of pricing or listing errors, we may cancel or refuse orders and issue refunds if payment has been captured.

4) Orders, Acceptance, and Cancellations

  • Your order is an offer to purchase. Order confirmation acknowledges receipt; acceptance occurs when we dispatch the product(s).

  • We may cancel or refuse any order for reasons including limits on quantities, inaccuracies, suspected fraud, payment failure, or issues identified by our fulfillment systems.

  • Customer-requested cancellations or modifications are not guaranteed after an order is placed; contact us promptly. Custom or pre‑order items typically cannot be canceled once processing begins.

5) Shipping and Delivery

  • Dispatch timelines: typically 3–7 business days within India. Delivery estimates are indicative and may vary due to courier constraints, regional serviceability, festivals/holidays, or unforeseen events.

  • Risk of loss passes upon delivery to the shipping address provided. Title transfers upon full payment.

  • Incorrect addresses, failed delivery attempts, or re‑deliveries may incur additional charges.

6) Returns, Exchanges, and Refunds

  • Return eligibility window: 5 days from delivery. Initiate a return request within this window with order details and supporting photos/videos where applicable.

  • Return conditions: items must be unused, unwashed, unaltered, with original tags and packaging intact. Sarees with blouse fabric cut/detached, customized items, pre‑orders, discounted/final sale pieces, and hygiene-sensitive products may be non-returnable except for manufacturing defects.

  • Quality check: returned items undergo inspection. If approved, refunds are processed to the original payment method or as store credit as per our policy. Shipping/COD fees (if any) are generally non-refundable.

  • Damaged/incorrect items: report within 48 hours of delivery with unboxing evidence where possible.

7) Product Care and Usage

  • Follow care instructions. Many premium/handloom sarees require delicate handling and dry cleaning. We are not liable for damage due to improper care, storage, or handling.

8) Accuracy of Information

  • We strive for accuracy; however, content, pricing, availability, and other information may contain errors or omissions. We may correct errors, update information, or cancel orders if any information is inaccurate at any time without prior notice.

9) Intellectual Property and Content Usage

  • All content—including photographs, videos, text, logos, graphics, designs, product names, and trademarks—is owned by or licensed to Aparna and protected by intellectual property laws.

  • No license is granted except for limited personal, non‑commercial use to browse and purchase products. You may not reproduce, copy, sell, resell, distribute, publicly display, modify, or create derivative works from our content without prior written consent.

  • User-generated content shared with us (e.g., testimonials, tagged posts) may be used for marketing and promotional purposes per our policies and applicable laws, with attribution where appropriate.

10) Third‑Party Services and Social Platforms

  • Our services may integrate with third‑party platforms (e.g., payment gateways, logistics, Instagram). Such platforms have their own terms and privacy practices. We are not responsible for third‑party actions, content, failures, or outages.

18) Indemnity

  • You agree to indemnify, defend, and hold harmless Aparna and its affiliates from any claim or demand, including reasonable attorneys’ fees, arising out of your breach of these Terms, misuse of the services, violation of law, or infringement of any third‑party rights.

19) Force Majeure

  • We are not liable for delay or failure to perform due to events beyond our reasonable control, including natural disasters, acts of government, war, civil disturbances, strikes, pandemics, lockouts, utility failures, or internet disruptions.

20) Changes to Terms and Policies

  • We may update these Terms and related policies at any time by posting the revised version with the updated “Effective Date.” Continued use constitutes acceptance of the changes. Please review periodically.

21) Governing Law, Jurisdiction, and Dispute Resolution

  • These Terms are governed by the laws of India. Subject to any alternative dispute resolution we may introduce, the courts at Kolkata, West Bengal shall have exclusive jurisdiction over all disputes.

22) Notices and Contact

23) Severability

  • If any provision of these Terms is determined to be unlawful, void, or unenforceable, the remaining provisions shall remain in full force and effect.

24) Entire Agreement

  • These Terms, together with applicable policies (Privacy Policy, Shipping & Delivery Policy, Returns & Exchanges Policy), constitute the entire agreement between you and Aparna and supersede prior understandings relating to the subject matter.
